Bridgestone/Firestone produces the tires for the E xplorer in various plants, namely Decatur , Wilson and Oklahoma City. Data shows that the rate of damage claims per million tires built in Decatur is more than double the rate for tires made in Wilson and nearly 10 times the rate of Oklahoma City, see Tables 1 and 2. An internal engineering review within the Decatur plant is underway. Bridgestone claims there was a problem with just 2 out of every 100,000 tires at its Decatur plant, which made the bulk of the problem tiresxiii. Recent reportsxi speculate that the tread separation is due to a local separation between two layers of steel that is “almost explosive” in nature and that the separation is caused due to excessive heat. Dick Baumgardner, a tire expert, said the treads on certain of the recalled tires are too wide and the corners too squared off. With a wider tread, more rubber comes in contact with the pavement, which tends to heat up the tire. If the corners are squared off, there is more stress — and again heat — on the edges of the steel belts. The depth and width of the tread grooves also affect how heat is dissipated and, thus, temperature as well.

The COMELEC, in its Resolution dated July 8, 1997, dismissed the PIRMA petition citing the permanent restraining order issued against it by the Court in Santiago. PIRMA and the spouses Pedrosa forthwith elevated the matter to the Court alleging grave abuse of discretion on the part of the COMELEC in refusing to exercise jurisdiction over, and thereby dismissing, their petition for initiative to amend the Constitution. The question, therefore, arises whether the proposed changes in the Constitution set forth in the petition for initiative herein involved are mere amendments or rather are revisions. Accordingly, since Article XVII states that Congress shall provide for the implementation of the exercise of the people’s right directly to propose amendments to the Constitution through initiative, the act of Congress pursuant thereto is not strictly a legislative action but partakes of a constituent act. The Americans in turn copied the concept of initiatives from the Swiss beginning in 1898 when South Dakota adopted the initiative in its constitution. In 1891, the Swiss incorporated the initiative as a mode of amending their national constitution. Initiatives promote “direct democracy” by allowing the people to directly propose amendments to the constitution.

Official Gazette of the Republic of the Philippines

In case of death, permanent disability, resignation or removal from office of the incumbent President, the incumbent Vice President shall succeed as President. In case of death, permanent disability, resignation or removal from office of both the incumbent President and Vice President, the interim Prime Minister shall assume all the powers and responsibilities of Prime Minister under Article VII as amended. Realizing the absurdity of the need for such an amendment, petitioner Atty. Lambino readily conceded during the oral arguments that the requirement of a future amendment is a “surplusage.” In short, Atty. Lambino wants to reinstate the rule of statutory construction so that the later provision automatically prevails in case of irreconcilable inconsistency. The abolition alone of the Office of the President as the locus of Executive Power alters the separation of powers and thus constitutes a revision of the Constitution. Likewise, the abolition alone of one chamber of Congress alters the system of checks-and-balances within the legislature and constitutes a revision of the Constitution.

Revisions are changes that affect the entire Constitution and not mere parts of it. The Congress shall provide for the implementation of the exercise of this right. Lambino expressly admitted that they printed only 100,000 copies of the draft petition they filed more than six months later with the COMELEC. Lambino added that he also asked other supporters to print additional copies of the draft petition but he could not state with certainty how many additional copies the other supporters printed. Lambino could only assure this Court of the printing of 100,000 copies because he himself caused the printing of these 100,000 copies. The complaint and other initiatory pleadings referred to and subject of this Circular are the original civil complaint, counterclaim, cross-claim, third (fourth, etc.) party complaint, or complaint-in-intervention, petition, or application wherein a party asserts his claim for relief.

How green is your office?

The present initiative is indisputably located at the far end of the red spectrum where revision begins. The present initiative seeks a radical overhaul of the existing separation of powers among the three co-equal departments of government, requiring far-reaching amendments in several sections and articles of the Constitution. The Lambino Group in effect argues that if Congress or a constitutional convention had drafted the same proposed changes that the Lambino Group wrote in the present stole my money initiative, the changes would constitute a revision of the Constitution. Thus, the Lambino Group concedes that the proposed changes in the present initiative constitute a revision if Congress or a constitutional convention had drafted the changes. However, since the Lambino Group as private individuals drafted the proposed changes, the changes are merely amendments to the Constitution. The Lambino Group trivializes the serious matter of changing the fundamental law of the land.

He told Estrella to complete his report on the case with the aid of one of the committee members, Porfirio V. Sison. The President said that, if the report could be ready this afternoon, he would send a Cessna plane to pick up the committee members so that they could personally submit their report. Malacañang again explained that any importer who had brought into the Philippines any merchandise in which the 17 per cent Exchange Tax Law applied, would not have to pay any exchange tax if he cleared his documents on “trust receipts”. At the same time the importer would also not have to pay the 17 per cent import tax, if his importation arrived before January 1. In this way, Malacañang explained, the government would face a possible less of revenue. Beginning January 1, 1956, the 17 per cent tax on imports, which is proposed to replace the 17 per cent exchange tax, will be in effect.

Many voters will never read the full text of the initiative before the election. More importantly, there is no process for amending or splitting the several provisions in an initiative proposal. These difficulties clearly distinguish the initiative from the legislative process. The proponents of the initiative secure the signatures from the people. The proponents secure the signatures in their private capacity and not as public officials. The proponents are not disinterested parties who can impartially explain the advantages and disadvantages of the proposed amendments to the people. The proponents present favorably their proposal to the people and do not present the arguments against their proposal. The proponents, or their supporters, often pay those who gather the signatures. On December 29, 1993, the Court of Appeals promulgated its assailed decision.
